| | 10-31-2008 - Patents and Trolls For a long time now. I've thought that the patent system was broken. How could a Troll charge an inventor, when the Troll isn't adding anything of value to society? Well, there was a court ruling recently that greatly limits software and business method patents. It must meet one of two criteria.
#1 - it is tied to a particular machine or apparatus
- or -
#2 - it transforms a particular article into a different state or thing. In other words, pure software or business method patents that are neither tied to a specific machine nor change something into a different state are not patentable.
Even thought the article states that it still can be appealed to the supreme court, I think it's a good start to correct things.
